Darius Miles' attorneys are asking a judge to throw out the capital murder charge against the former Alabama basketball player.

Miles and friend Michael Davis are accused of the fatal shooting of Jamea Harris near the Strip entertainment district in Tuscaloosa on Jan. 15.

Miles sat in a Tuscaloosa County courtroom Monday for an immunity hearing.

His lawyers are claiming he is immune from prosecution since he acted in self-defense under Alabama law.

For much of Monday's hearing, Judge Daniel Pruet focused on the certification of a number of exhibits, like a series of security videos, 911 calls and video from Jamea Harris' cell phone.

One 911 call made by an eyewitness of the shooting was played for the judge.

The woman claimed to have seen who fired the first shot and said he was wearing a red and black plaid flannel shirt before fleeing the scene.

There was also a significant section of a University of Alabama Police Officer's body camera video shared in court.

It offered a conversation the officer had with a man who attorneys identified as the brother of Jamea Harris' boyfriend, Cedric Johnson.

You could hear the agitated brother talking about how his crew of Birmingham friends were not scared of federal agents, the Navy or spending 30 years in prison for shooting someone.

Defense attorneys claim they have been unable to serve Johnson with a subpoena for him to come to testify in court about who fired first.

In fact, one private investigator told the judge his staff showed up at Johnson's most recent address to serve him, only to have Johnson's mother tell them she did not know Johnson and that he did not live there.

Miles' immunity hearing resumes Tuesday morning in Judge Pruet's courtroom.
